Terms and Conditions for the Purchase of Coffee Beans and Coffee Grounds

These Terms and Conditions ("Agreement") govern your purchase of coffee beans and coffee grounds ("Products") from CANECA Coffee Roasters ("Seller"). By placing an order for Products, you ("Buyer") agree to be bound by these terms and conditions.

1. Product Description and Availability a. The Seller will make reasonable efforts to accurately display and describe the Products, including origin, roast level, grind size (for grounds), and any other relevant characteristics. b. Product availability is subject to change without prior notice. The Seller reserves the right to limit the quantity of Products sold.

2. Ordering and Acceptance a. All orders placed by the Buyer are an offer to purchase the Products under these Terms. b. Orders are not binding until accepted by the Seller. Acceptance will be communicated through an order confirmation email or other written notification. c. The Seller reserves the right to refuse or cancel any order for any reason, including but not limited to, product availability, errors in pricing or product description, or suspected fraudulent activity.

3. Pricing and Payment a. All prices for Products are as listed on the Seller's website or other sales platform at the time of order placement. b. Prices do not include applicable taxes, shipping, handling, or other charges, which will be added to the total order amount. c. Payment must be made in full at the time of order placement using the payment methods accepted by the Seller.

4. Shipping and Delivery a. The Seller will arrange for shipment of the Products to the address provided by the Buyer. b. Shipping dates and delivery times are estimates only and are not guaranteed. The Seller is not responsible for delays caused by the shipping carrier or unforeseen circumstances. c. Risk of loss and title for Products pass to the Buyer upon the Seller's delivery to the carrier.

5. NO REFUNDS AND ALL SALES ARE FINAL a. Due to the perishable nature of coffee beans and coffee grounds, and for reasons of hygiene and food safety, all sales of Products are final. b. The Seller does not offer refunds, returns, or exchanges for any Products purchased. c. This no-refund policy applies to all circumstances, including but not limited to, dissatisfaction with taste, incorrect grind size selection by the Buyer, or change of mind. d. Buyers are encouraged to carefully review their orders before purchase.

6. Limitation of Liability a. In no event shall the Seller be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the purchase or use of the Products, even if the Seller has been advised of the possibility of such damages. b. The Seller's total liability for any claim arising out of or relating to these Terms or the Products shall not exceed the total amount paid by the Buyer for the specific Products giving rise to the claim.

7. Governing Law and Dispute Resolution a. This Agreement shall be governed by and construed in accordance with the laws of Maryland, without regard to its conflict of laws principles. b. Any dispute arising out of or relating to this Agreement shall be resolved through the courts located in Maryland.

8. Entire Agreement a. This Agreement constitutes the entire agreement between the Buyer and the Seller regarding the purchase of Products and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral.

9. Severability a. If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

10. Amendments a. The Seller reserves the right to amend these Terms at any time. Any changes will be effective immediately upon posting on the Seller's website or other notification to the Buyer.

By proceeding with your order, you acknowledge that you have read, understood, and agree to be bound by these Terms and Agreement.
